Karnataka HC Divorce Ruling: Marriage is a Sacred, Eternal Union, Not Contract

Karnataka HC Divorce Ruling Karnataka High Court denies divorce, The Ruling came while dismissing an appeal against a Family Court order that had denied divorce under Section 13(1)(ia) of the Hindu Marriage Act, which permits dissolution of marriage on the ground of cruelty. Rejecting the plea, the High Court observed that Hindu marriage is traditionally viewed as a divine bond “Created in heaven and fulfilled on earth.” Referring to Hindu rituals, the Court noted that in the presence of the sacred fire, the couple vows to uphold the fourfold purposes of life Dharma, Artha, Kama and Moksha signifying a lifelong commitment to righteousness, prosperity, love, and spiritual liberation. The ceremony, the Court said, reflects nor merely a social arrangement but a spiritual partnership.

on the facts which has been stated in the case, this are the things which the court found, the marriage had taken place in 2012 according to Hindu customs and that the wife had stayed in the matrimonial home for only 21 days from the marriage.

Karnataka HC Divorce Ruling It was held that the allegations placed on record did not establish “unbearable cruelty” as required by law to justify dissolution of marriage. Karnataka HC Divorce Ruling also remarked that the evidence had been thoroughly examined by the Family Court, which had reached a reasoned conclusion.

Karnataka High Court concluded by stating that no legal error or perversity was shown in the Family Court’s findings, the High court of karnataka declined to interfere and upheld the denial of divorce, reiterating that matrimonial relief cannot be granted unless statutory grounds proved with credible evidence are clearly made out.
